A legal disclaimer

JPT Service provides tax preparation and consulting services in accordance with California state regulations and CTEC registration requirements. The information and services provided are for tax preparation purposes only and do not constitute legal or financial advice. JPT Service is not responsible for any errors resulting from inaccurate, incomplete, or misleading information provided by the client. All tax returns are prepared based solely on the information and documentation provided by the client. Clients are responsible for the accuracy and completeness of all information submitted. JPT Service assumes no liability for any penalties,  interest, or additional taxes assessed by the IRS or any state tax authority resulting from omitted or incorrect information provided by the client. JPT Service does not provide legal representation before the IRS or any tax authority. For audit representation or legal tax matters, clients are advised to seek a licensed attorney or Enrolled Agent.

TERMS OF USE AGREEMENT

This Terms of Use Agreement (“Agreement”) is a legally binding contract between you (“User,” “you,” or “your”) and JPT Service, a California-based tax preparation service (“we,” “us,” or “our”). By accessing, browsing, or using any portion of our website, services, tools, forms, or communications (collectively, the “Website” or “Services”), you expressly agree to be bound by all terms, conditions, disclaimers, and policies contained herein. If you do not agree to all terms of this Agreement, you must immediately cease all use of the Website and Services.

 

1. ACCEPTANCE OF TERMS
Your use of the Website or Services constitutes your unqualified acceptance of this Agreement, including any future amendments or updates. If you are using the Website or Services on behalf of a business, organization, or entity, you represent and warrant that you have the legal authority to bind that entity to this Agreement. You further acknowledge that you are at least 18 years of age and capable of entering into legally binding contracts under applicable law.

2. SCOPE OF SERVICES
JPT Service provides tax preparation, filing, and consulting services exclusively for individuals and small businesses located in California. We operate under the authority of the California Tax Education Council (CTEC) as a Registered Tax Preparer (CRTP) and hold a valid IRS Preparer Tax Identification Number (PTIN). We are not an Enrolled Agent (EA), Certified Public Accountant (CPA), or attorney, and we do not provide legal, financial, or investment advice. We do not represent clients before the IRS, California Franchise Tax Board, or any other tax authority.

3. CLIENT RESPONSIBILITIES
You, as the User, are solely and exclusively responsible for:

- Providing complete, accurate, truthful, and timely information and documentation necessary to prepare your tax return.
- Reviewing all tax forms and schedules prior to submission for accuracy and completeness.
- Maintaining copies of all documents, receipts, and records used in the preparation of your return.
- Reporting any changes in your tax situation (e.g., income, deductions, credits) to us prior to filing.
- Understanding that any errors, omissions, or misrepresentations in the information you provide may result in penalties, interest, audits, or other adverse consequences imposed by the IRS or state tax authorities — for which JPT Service bears no responsibility.

 

4. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JPT SERVICE, ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH:
- YOUR USE OR INABILITY TO USE THE WEBSITE OR SERVICES;
- ANY ERRORS, OMISSIONS, OR INACCURACIES IN TAX RETURNS PREPARED BY JPT SERVICE DUE TO CLIENT-PROVIDED INFORMATION;
- ANY AUDITS, PENALTIES, INTEREST, OR ADDITIONAL TAXES ASSESSED BY THE IRS, CALIFORNIA FRANCHISE TAX BOARD, OR OTHER GOVERNMENTAL ENTITIES;
- ANY CLAIMS, ACTIONS, OR DEMANDS ARISING FROM YOUR USE OF OUR SERVICES;
- ANY THIRD-PARTY CLAIMS, INCLUDING THOSE RELATED TO DATA BREACHES, IDENTITY THEFT, OR FRAUD, UNLESS SUCH BREACH IS DIRECTLY CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

JPT SERVICE'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

 

5. FEES & PAYMENT TERMS
All fees are quoted in advance and are based on the complexity of your tax situation, including but

not limited to: number of forms, income sources, deductions, credits, and state filings. Fees are non-refundable unless otherwise agreed in writing. Payment is due upon completion of services unless otherwise specified in a written service agreement. Fees are not contingent upon the outcome of your tax return, refund amount, or any other tax-related result. You agree that you will not seek to recover any portion of your fee based on the outcome of your return.

6. PRIVACY & CONFIDENTIALITY

All personal, financial, and tax-related information you provide to JPT Service is treated as strictly confidential and protected under applicable federal and state privacy laws, including the IRS Taxpayer Bill of Rights and California Consumer Privacy Act (CCPA). We will not disclose your information to any third party except:
- As required by law (e.g., IRS e-filing, subpoenas, court orders);
- To transmit your return to the IRS or state tax authorities;
- With your express written consent.

7. NO GUARANTEE OF RESULTS

JPT Service makes no representations, warranties, or guarantees regarding:
- The amount of any refund, credit, or deduction you may receive;

- The outcome of any audit or examination by the IRS or state tax authorities;
- The timeliness or accuracy of any tax return filed on your behalf;
- The applicability of any tax law, regulation, or interpretation to your specific situation.

Tax outcomes are determined by applicable laws and the accuracy of information provided by you. We do not guarantee any specific tax result.

8. INTELLECTUAL PROPERTY
All content on the Website, including but not limited to: text, graphics, logos, button icons, images, audio clips, trade names, trademarks, service marks, trade dress, digital downloads, software, forms, templates, and the compilation of any of the foregoing, is the exclusive property of JPT Service or its licensors and is protected by United States and international copyright, trademark, and patent laws. You are granted a limited, revocable, non-transferable, non-exclusive license to:
- View, print, and download content solely for your personal, non-commercial use in connection with our Services;
- Not modify, create derivative works, reverse engineer, decompile, or disassemble any content or software;
- Not reproduce, distribute, sell, rent, lease, sublicense, or otherwise exploit any content for commercial purposes;
- Not frame, mirror, or link to any portion of the Website other than the homepage without our prior written permission.

Any unauthorized use of our content may constitute copyright infringement and may subject you to legal action.

9. USER CONDUCT & PROHIBITED ACTIVITIES
You agree that you will not:
- Use the Website or Services for any unlawful, fraudulent, deceptive, or abusive purpose;
- Attempt to gain unauthorized access to any portion of the Website, including password-protected areas;
- Use any automated tool (e.g., bot, scraper, spider, crawler) to monitor, copy, or extract content from the Website;
- Transmit any virus, malware, spyware, or other harmful code;
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
- Post, transmit, or distribute any content that is defamatory, obscene, pornographic, threatening, harassing, discriminatory, or otherwise objectionable;
- Advertise, promote, or solicit any commercial product or service through the Website;
- Interfere with the operation of the Website or disrupt the experience of other users;
- Collect or store personal data about other users without their express consent;
- Use the Website to engage in any activity that violates applicable laws, regulations, or third-party rights.

 

10. THIRD-PARTY LINKS & SERVICES
The Website may contain hyperlinks to third-party websites, services, or resources (e.g., IRS, FTB, TurboTax, Intuit, tax forms). These links are provided for your convenience only. We do not control, endorse, or assume responsibility for the content, accuracy, privacy policies, or practices of any third-party site. Your use of any third-party site is at your own risk. We recommend reviewing the privacy policy and terms of use of any third-party site before disclosing personal information.


11. USER CONTENT & COMMUNICATIONS
You may submit questions, comments, or feedback to us via email or contact forms. Any such communications (“User Content”) are not confidential and may be used by us for internal purposes, including service improvement, quality assurance, or legal compliance. You grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media or format.

You agree that:
- All User Content you submit is accurate, lawful, and does not infringe any third-party rights;
- You are solely responsible for the consequences of submitting User Content;
- We may remove or delete any User Content at any time, for any reason, without notice.


12. CHANGES TO TERMS
We reserve the right to modify, update, or replace this Agreement at any time and at our sole discretion. Any changes will become effective immediately upon

posting to our website. We encourage you to review this Agreement periodically to stay informed of any updates. Your continued use of our website or services following the

posting of any changes constitutes your acceptance of the revised Agreement. If you do not agree to the updated terms, you must discontinue use of our website and services immediately. We will not be held liable to you or any third party for any modification, suspension, or discontinuation of our services.
